Terms & Conditions
1. General
All lots are offered for sale by public auction and are sold under these Terms & Conditions. Any person bidding at the auction, whether in person or online, is deemed to have read, understood, and agreed to these terms.
2. Condition of Lots
All items are sold “as seen, where is” and without any warranty. Descriptions, photographs, condition reports, and any statements made verbally or in writing are provided in good faith and for guidance only and shall not form part of any contract. All such statements are opinions only and are not statements of fact.It is the sole responsibility of the bidder to inspect and satisfy themselves as to the condition, quality, functionality, safety, age, mileage/hours, and authenticity of any lot prior to bidding. No allowance, refund, or return will be made on account of any defect, fault, damage, error, or omission, whether discovered before or after the sale.
3. Bidding & Sale
The highest bidder at the fall of the hammer shall be the purchaser. In the event of any dispute, the Auctioneer’s decision shall be final.Some items may be sold “conditionally” and are subject to the vendor’s consent. Where vendor consent is required, the purchaser shall be notified as soon as practicable. Once consent is given, the sale becomes binding and full payment and collection are required.
4. Online & Hybrid Bidding
The Auctioneer accepts bids from bidders attending in person and via online platforms.The Auctioneer shall not be responsible for any failure of internet connections, software, bidding platforms, technical delays, missed bids, or errors arising from online bidding systems. Bidders using online platforms do so entirely at their own risk.
5. Risk & Title
Risk in the lot passes to the purchaser immediately at the fall of the hammer.Legal title to the lot shall not pass to the purchaser until full cleared payment has been received by the Auctioneer.
6. Buyer’s Premium
VAT & Commission A buyer’s premium of:10% plus VAT on items up to €1,000 5% plus VAT on items over €1,000 VAT is not applicable to lots unless stated by the Auctioneer or in the catalogue.
7. Payment
All purchases must be paid for in full on the day of the auction, unless otherwise agreed in writing.Accepted payment methods shall be determined by the Auctioneer. No lot shall be released until payment has cleared in full.
8. Collection
Storage & Removal All purchased items must be collected within 72 hours of the auction.Failure to collect within this period will incur a storage charge of €20 per day, per lot, without notice.The purchaser is responsible for all costs and risks associated with loading, transport, and removal. The Auctioneer accepts no responsibility for damage caused during loading or removal.
9. Buyer Default
If a purchaser fails to pay for or collect a lot within the required time, the Auctioneer may, at its absolute discretion:Cancel the sale Resell the lot Retain any monies paid Recover any losses, storage fees, resale costs, or legal expenses from the purchaser
10. Vendor Warranties
Vendors warrant that they are the lawful owner of the items offered for sale or have full authority to sell them and that the items are free from any finance, charge, or third-party claim.
11. Limitation of Liability
Neither the Auctioneer nor its employees or agents shall be liable for any loss, damage, or injury howsoever caused, except where required by law.The Auctioneer shall not be liable for any indirect or consequential loss, loss of profit, or business interruption. Any liability, where it exists, shall be limited to the hammer price of the lot concerned.
12. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of Ireland, and the courts of Ireland shall have exclusive jurisdiction.
